Virginia steps up on consumer privacy

Last Tuesday, Virginia Governor Ralph Northam signed the Consumer Data Protection Act into law—and with his signature, Virginia joins California in leading the charge for consumer privacy across the country.

Virginia's new privacy law looks a lot like California's, empowering consumers to:

  • Know what companies have your data -- and what data they have

  • Delete your data from companies that shouldn’t have it

  • Stop companies from selling your data

But in some ways Virginia goes even further, granting consumers additional rights to:



  • Correct inaccuracies in data companies have collected on you

  • Opt out of targeted advertising and other individual "profiling"

California and Virginia may be the first two states to pass strong consumer privacy laws, but they will certainly not be the last:

  • Florida's governor and house speaker introduced a strong consumer privacy bill on February 15

  • Minnesota, New York, North Dakota, Oklahoma, Utah, and Washington State are actively considering similar legislation

  • To avoid a patchwork of competing state privacy laws, Congress may finally step in as well to create a national privacy standard
